JUDICIAL REVIEW MATTER
FAVOURABLE SETTLEMENT WITH IRCC
Our client's work permit extension application from inside Canada was refused due to missing documents. The officer stated the following documents were not provided:
-
Support letter from a provincial or territorial government outlining that the foreign national has been placed in Expression of Interest pool or application inventory process under the Provincial Nominee Program of their province or territory of residence
-
Letter of employment from current employer
-
Family Information form (IMM 5707)
The Applicant had submitted the employment reference letter to the provincial body prior to receiving the Provincial Work Permit Support Letter and submitted the provincial letter via web form.
We argued that the omission was not intentional and the officer failed to consider the overall context and evidence on record.
We are pleased to share that IRCC agreed to settle the matter in our client's favour within a short span of time.
